Case Study: VVVVVV Let’s Plays VS TuneCore VS YouTube Copyright Claim VS @terrycavanagh

VVVVVV Copyright Claim

Good news! Well, kind of… For those wondering about the recent YouTube copyright situation we now have a more public case study with which to analyze. Analytically guided business minds such as myself are happy to check this out for stock investors wondering what’s going to happen to all of these budding “Let’s Play” channels… *rubs hands together* so exciting!

VVVVVV’s Terry Cavanagh has a contract with TuneCore and unfortunately the situation is really simple when you finally get down to it. There will be no Let’s Plays monetized of this game due to that contract. Initially Terry inquired with TuneCore what the heck was going on after “INDMUSIC” had placed a copyright claim on a trailer Terry made for his own game VVVVVV. The details of his contract (which his legal team may have failed to notify him of) clearly specify that he can whitelist his own YouTube channel / Spotify accounts for the soundtrack etc. but what happens then is Terry collects his own revenue directly.

In the event that a non-whitelisted channel uploads something (insert random Let’s Play channel name here) that third party will have their video copyright claimed and the monetization will be feeding money to TuneCore via INDMUSIC instead which will then pay a cut to Terry at some point later down the line. In other words, Terry wanted to let gamers do Let’s Plays and profit from it, but unless he re-negotiates, fights the meaning of, or terminates his contract – that isn’t going to happen.

Perhaps important to note, the videos were not being deleted, gamers can still upload coverage of his title they just can’t profit from it. Who will support now that they can’t make money? Probably people with websites who still benefit from YouTube’s massive hosting capabilities… we’ll find out I guess. Hit us up if you’re reading this Terry, we haven’t monetized our YouTube videos for over a year and have remained ad-free until the new copyright system came into place which now seeks to apply monetization for the rights holder (you Terry, and your corporate partners).
